A proper estate plan or what I would call a fundamental estate plan includes a will and advanced directives. The advanced directives are the durable power of attorney, designation of healthcare surrogate, and living will. The will, of course, designates the beneficiaries of your estate upon passing. It also allows you to name the personal representative or person who will represent you before the court, and also name any minor guardians for minor children. Then, of course, the advanced directives are necessary to avoid guardianship in the event of your incapacity during your lifetime.
