The Florida statutes protect surviving spouses and minor children. You cannot completely disinherit a spouse unless there's a prenuptial agreement that was created as part of the estate plan. Spouses are protected. Minor children are protected as well, but not adult children. As the creator of a will, you have the right to leave your estate to anyone provided you've taken care of a surviving spouse and minor children only.
